Does this work at banks and retail outlets? Is it only good for the private property of citizen tax payers? Does it apply to government property as well? Will this apply to people who aren't convicted felons who are on parole?

My response (#15) was, of course, written in jest.

The Law distinguishes between burglary, robbery, simple theft (petty larceny), etc. - so the fact that here, the Court will not prosecute for burglary doesn't mean that the perp will get off scot-free.

I am guessing this is the same “rationale” that when a 6’6” 250lb muscle guy says to the 80 yr old lady.. “give me your wallet, please”.

it isn’t actually theft, as they did not implicity say “or else”?

On the prosecutor...
The dude charged the perp with the wrong crime, according to state law.
The prosecutor is supposed to know this.

Fire him

They did not have a picture of the perp. My guess is that the owner may have been scared of him because the thief may have been black, and the homeowner may have been scared that the guy would beat the snot out of jom.

Gas powered?

If the perp uses it, it is a life sentence for the carbon emissions.

Or, the perp saved the erf by putting taking it out of use.

This is headed toward the wise latinx.

Theft, sure, but “breaking and entering” kind of requires breaking and/or entering. Walking onto unsecured property that doesn’t have certain signage in place doesn’t qualify.

I do think I remember one case where they tried to prosecute someone for bank robbery, but the case failed because the perp had handed the teller a note that said something like “Give me all your money please” but the note did not include any explicit threat, and since no other statement or threatening action was made, the jury ruled it wasn’t actually a robbery by force.
