This is a NY state case so it would be in NY state court. Now, if NY looks like they are in trouble making the case then it is possible that the DOJ could file an IRS case in Federal court, but it would still have to be in NY. Sullivan is in DC.

I think the problem is that a “Trump DOJ” never really existed. Starting from the top down, those two turncoats he selected to head up the agency never worked on behalf of Trump or his policies. Yep, I hold Jeff Sessions personally responsible.
