It’s interesting (and telling) that he holds Chase’s words as praiseworthy when it dovetails to his agenda and otherwise mocks the man...

Show me a lost causer who doesn't think that when Chase wrote the Texas v White he was a tool of the administration in fear of his life and when he talks about the Davis trial he's words are coming from a burning bush. You can't.

But the sovereign has the power to lay claim to any land within its territory.

Not if it doesn't belong to them.

no matter who it belongs to. Go to any country on earth. If the government needs your land for a public purpose it can take your land. It may have to pay you fair market value, but it can take your land. That is universal.

By what measure?

value of goods imported and exported.

...and was obviously the largest in South Carolina. And Guantanamo City is obviously the largest port in Guantanamo province. What's your point?

South Carolina is not a province. It is a sovereign state.

Chase also said Texas secession was null, void and unconstitutional. He was right about that. You may find that a startling admission to make.

Chase's ruling was a farce. He and 4 other Lincoln appointees decided the case. Tell ya what. Lemme appoint 5 justices of my choosing. Then we'll see what the court says....nevermind the obvious farce of him ruling his own action constitutional.

Not startling at all. Secession is not treason. The Constitution says treason "shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort." Secession, even secession done illegally, does not meet that definition. And rebellion, armed rebellion like that waged by the southern states, may or may not rise to the level of treason either since by definition war is waged between sovereign nations and not parts of the same one. However the term 'civil war' seems to mean it does fall under the constitutional definition. One can argue either way.

there was no rebellion by the Southern states. They owed no allegiance to the federal government in Washington DC the capital of a foreign country after they had seceded. It was not a civil war.

Chase's opinions of the illegality of the Southern actions were made clear in several court cases. Chase may have thought the trial of Jefferson Davis was unwise but he never thought it was illegal. If he had he could have easily refused to participate or insist the charges be dropped. It wasn't until the passage of the 14th Amendment that Chase found a loop-hole he could use to end the trial, which he did without ever saying Davis had been charged improperly.

As I've already discussed earlier, Chase's ruling was a farce.

I believe that what he is asking is what is the legal procedure for leaving the Union. Is it the same as the process to join?

That would be up to each state. Some held referendums. Some elected delegates and held secession conventions that mirrored their constitutional ratifications. As each state is sovereign, it is for each to determine what the correct procedure is.

Yes he did. He sent an armed flotilla into a foreign country's territory. Learn some history moron. Lincoln started the war. Invading somebody else's home is an act of aggression. Try reading some actual history for a change instead of Yankee Propaganda.

As is obvious by now, the central tenet of PC Revisionists is that it was all about slavery slavery slavery.....nevermind that slavery was not threatened. Nevermind that the North was only too happy to preserve slavery due to the immense profit it generated for them and that they signaled their willingness to protect it by express constitutional amendment effectively forever. Nevermind that they passed a congressional resolution specifically saying they were not fighting over slavery.

Oh well then it must have been the spread of slavery.....just don’t bother to notice that the Southern states were quite happy to leave with nothing more than their own territory making utterly no claim on the territories of the US in the West. oops.

Does the same apply to every supreme court ruling? Dred Scot? Plessy vs Ferguson? Roe vs Wade? People have always disputed Supreme Court rulings they disagreed with. Get over it.

Incorrect. Abe Lincoln started the war. He invaded the sovereign territory of South Carolina. He did so fully intending to start a war and did so without the consent of Congress. He did it for money and empire.

Whereas its obvious you're not very bright and completely incapable of doing anything other than spewing the PC Revisionist dogma you cling to. The Confederacy seceded peacefully from the Union. Lincoln invaded their sovereign territory and started a war. And its the War of Northern Aggression. Get it right.
