They are not defending the border from actual invasion as defined by the law of armed conflict or relevant American law. They are assisting in a law-enforcement mission that is mainly designed to prevent the commission of federal misdemeanors, not to stop an army that intends to take and hold American territory.

What the National Guard Cannot Do on the Border

Article 4 section 4 of the Constitution.—The U.S. SHALL protect the states from invasion. Whether they’re carrying arms, drugs, vd, deadly diseases,etc...The end result is the same. Our country is being conquered, and colonized. And the real citizens are being forced to fund it all.

Ultimately, it’s the POTUS’ call on how to treat the invaders.
