The officer who used the rifle, Michael Bucher, said during an internal investigation that he saw Kirschner chasing another man with a big chain. Bucher said he fired one round and Kirschner fell, but then fired again after he saw Kirschner get up on one knee and swing the chain. The officer said Kirscher then stayed on the ground.
One bad guy shot another bad guy in the ass. That is not a fatal injury. The fatal injury came from the cops via a .223 rifle I would suspect a bleed out of the femoral artery as he hit him in the leg.
What I really think happened that day is bad guys were fighting bad guys and a poorly trained police department went stupid and rogue. The DA wanted to make a political name for himself and indicted everybody. He will cost Waco millions of dollars in later suits.
What I have never understood is the fact that the police knew there might be trouble there that day. Why in the hell did they set up outside and make the Twin Peaks a virtual free fire zone? If they really wanted to stop trouble they should have had twenty or thirty officers inside in full uniform. If the Waco police had done this, nothing would have happened that day.
This stinks of total incompetence. Waco will pay dearly for this.
It sounds like someone shot the chain wielding biker in the butt while trying to protect themselves from his chain swinging then a cop shot him twice in the legs.
One of the bullets must have hit a major artery to make him bleed out. I find it interesting all these shots were below the belt. Was this 3 bad shots by two different people trying to stop an attacker that still managed to stop him?
Just read your post and agree. If this wasn’t so serious it could almost be considered slapstick comedy due to the blatant incompetence. I don’t blame the average cop on the scene; just those who were in charge of this comedy of errors.
One possibility is that Mexican gangs wanted to eliminate gringo competition and asked local authorities for a favor.
Thus, clear these guys as well. Who is to say which of three shots killed the guy, else maybe the police simply stood and watched him bleed out. Clear already should be revisited.
The operation was set up and run by the feds and the state. The local guys were just muscle.
That theory is alive and well in parts of Texas.

Firearms are not “registered” in Texas. This ain’t New Jersey.
Thus, I do not know what a gun “registered” to the accused even means.

There is a rumor that the police were actually there to support one side against the other. They did not intend to kill scumbags on both sides, just one.
In return the police chief and DA get big bags of money from the favored group.
