Says all that needs to be said.
1) Obamacare does not apply to 95% of the citizens and residents of the U.S.
2) Obamacare is definitely a tax.
3) There are no provisions in the Obamacare law for collecting this tax.
1. As for the actual percentage, it’s a guess. People who are corporately officers or representationally affiliated, including government employees, as defined in those three sections of the tax code, are liable for the income tax. Obviously, that leaves over two hundred million people out of it.
2. Obamacare is definitely a tax, and not even through a new legal mechanism - it’s incorporated through a part of the tax code that’s been used this way before for other things. That’s what Roberts pointed out.
3. There are no provisions in the Obamacare law to collect the tax, because Obamacare had been made a part of the calculation section for the income tax. So collections for Obamacare are, in fact, collections for the income tax. That’s why Roberts pointed out the limitations of the income tax - because THAT’S where you get out Obamacare.
