Reminds me of an argument I had with an atheist in college.
I said, if we're just random chemical processes, then who really cares if my random chemical process shoots your random chemical process in the head?
His reply: "You're taking this random chemical process business too far."
And another agnostic roommate came home one night complaining about having been at a bar and watching a class mate humble a stripper in the bar in front of everybody. He said that was wrong.
Me: "If there is no God, what's wrong about it?"
Him: "I don't know, I just know it's wrong."
Me: "Maybe you were designed to know that it's wrong."

Certainly the gun was to blame. Had nothing to do with booze or coke (which king hussein says he did when they could get it) or the person that pulled the trigger.

Yim became enraged and grabbed his gun after Phan asked Yim where God was when Yims father died of a stroke several years earlier.Mr Phan found out that the guy with the gun will always get the last word.

Interesting. It's like why we are different from animals. A bear will not feel remorse about eating a toddler that wondered from a camp site. We don't blame the mauling of a human on the vicious dog, but its owner or even its breed (race). Still there are some animals that seem to demonstrate emotional feelings when one of their own offspring dies (elephants, etc.).
What makes us special that we know right from wrong? If we are no different than animals, we should not have these moral instincs beyond our own race (humans). But we do.

That's provoked heat of passion under the influence, not premeditation.
So second degree probably, third degree maybe.
But not first.
