There is a difference between negligence and criminal negligence. If you blow through a red light and hurt me or mine, because you didn’t see it, you are liable for the damages but not criminally liable. You are responsible for the injuries and damage.
If I don’t watch your daughter carefully, I am negligent but not criminally.
If, however, I have consumed 5 drinks and am too wasted to react and stop at a red light, I am criminally negligent.
And, if I leave my 8 year old in charge of your 7 year old and she drowns while I’m out having my nails done, it’s probably gross negligence and maybe criminal.
In this case, there would be a civil penalty if it was your kid, not his. The ones injured are his family. And it was a very stupid mistake, not a crime.
