Breach of contract. I’m sure Comcast has in their privacy policy a clause about holding financial information private.
By breaching that agreement, they open her up to identity theft and financial fraud.
I used to see that all the time, but it’s been a while since I’ve seen posted bounced checks. The fact that most people don’t use checks anymore coupled with the possibility of identity theft has made that practice fairly rare I would imagine.
Please - I’m not being snide here, but why would I want to steal the bank account number of someone that bounces checks? If they have no money in the account, it wouldn’t make sense to steal from them.
You could apply for a credit card using the bank information as a source of ID.
The Nigerians will take any bank account and tap it dry.
Yes, but what are her monetary damages? The cost of opening up another account?
I don’t know. I know that the actual damages will pale in comparison to the punitive damages that she will win.
