I had seen a rumor a couple of weeks ago that the DukeLax story for 60 Minutes had been delayed until the 10/1 air date. So I don't know.

That said, I've never had much faith in 60 Minutes. For them to do a show exposing the hoax would require 60 Minutes to go against every PC story they've ever done. I don't see it...

I guess what is good for the goose is not good for the gander.

Apparently, Nifong believes that only he is entitled to taint the jury pool with his comments exploiting the race, gender, class and residence issues underlying this case.

I know a little bit about changes of venue in criminal cases. First, it is painfully obvious that such a change of venue is warranted in this case. In my state, I would say getting the change would be a slam dunk due to the excessive publicity aimed at this case. Second, it is perfectly proper to commissin a scientific study to measure the community's knowledge about the case and the prevailing attitudes. The results could be used in evidence in a change of venue motion. Also, such a survey could be an aid in jury selection if the case is not moved. Finally, it is almost beyond gall for Nifong to accuse anyone else but himself of trying to taint the jury pool.

Nifong wants lawyers to testify about role in survey

DURHAM - District Attorney Mike Nifong wants a judge to order the defense lawyers in the Duke University lacrosse case to testify under oath about their role in commissioning a survey that the prosecutor says was designed to influence potential jurors.

On Sept. 11, a surveyor from New York called Nifong's home to conduct "a survey about things that were happening in the Durham community."

"Many of the questions asked, however, actually constituted a thinly-disguised attempt to influence the opinions of the respondents," Nifong wrote in a motion filed this afternoon. If the lawyers were involved in that survey, Nifong wrote, they would be in violation of the State Bar rules.

The surveyor spoke to Nifong's wife, Cy Gurney for an hour, according to an affidavit included with the motion. The first question was something like:

"If the prosecutor in a community took on a sensational case right before a primary/election, do you think such a case would be handled for political gain?" Gurney wrote in a sworn statement.

The interviewer went on to ask questions about what Gurney knew about the case and her opinions on the guilt or innocence of the three lacrosse players charged with raping an escort service dancer who was hired to dance at a March house party.

The surveyor "seemed more interested in telling a story than in getting my answers, as some of the questions were very long and tailored to a specific point of view," Gurney wrote in her sworn statement.

Nifong is asking Superior Court Judge W. Osmond Smith III, who is assigned to the case, to order each of the attorneys in the case to state under oath what part he or she played in the survey. Nifong is also asking the judge to order the surveying to be halted. The case is scheduled for a hearing Friday.

(09/20/06 -- DURHAM) - Durham's district attorney says defense attorneys in the lacrosse rape investigation are trying to taint the potential jury pool.

Nifong filed a motion Wednesday saying that his wife, Cy Gurney, got a call around 8 p.m. on September 11 from a research company in New York.

She was asked to participate in a survey and wrote down all of the questions from the caller when she realized it related to the Duke lacrosse rape case.

In the hour-long phone call, Gurney says that the caller "was more interested in telling a story" and that the questions "were tailored to a specific point of view." She said some of the questions included "Do you think the lineup was improper?" and "If the victim did not have any DNA evidence of the players, do you think a rape occurred?"

The caller did not say who hired the company to conduct the survey.

In his motion, Nifong wants the defense attorneys to say what part they might have played in the survey. He also wants a judge to stop the surveying.

The defense says that it had the right to conduct the survey and told Nifong about it in August. The survey was aimed at 300 random people.

Defense attorneys say they had the right to conduct the poll because they felt their clients' right to a fair trial was threatened by Nifong's public comments in the days after the alleged rape.
