Her spokesman, Elliot Mintz, confirmed the arrest and said police detected the minimum blood-alcohol level to warrant an arrest. The legal limit in California is 0.08 percent.

The driving under the influence symptoms were "probably the result of an empty stomach and working all day and being fatigued," Mintz said.

Stupid spokesman. If he was wise he would have said that she was well rested and had eaten earlier. Being exhausted is no excuse for driving drunk--in fact it aggravates the problem. With the spokesman's statement the prosecuting attorney will be able to say that she was less in control of her car than a normal person with a 0.08 BAC.

I wonder what they meant by the "minimum blood-alcohol level to warrant an arrest." In my state that would be .05%, even though .08% is the statutory BAC level that will get you convicted. At .05% or better but below .08%, they''d still have to prove that you were intoxicated. At .08% or higher, there is no need whatsoever to prove intoxication, only that your BAC was at or higher than the legal limit. It could be that Hilton registered less than .08%. It could also be that her lawyer will argue that the BAC test is not entirely accurate and that it could have easily shown .08% when her actual BAC was .07% or lower. To cover their bases in case the judge or jury agrees that the test is not entirely accurate (it's not), prosecutors would try to prove that Hilton was intoxicated. The defense would try to rebut their proof of intoxication by making a case that she was overworked and exhausted and that's what made her appear intoxicated. Saying she only had one drink on an empty stomach may seem stupid, but then again if a jury were to believe that she only had one drink that might be a mitigating factor that makes them less likely to convict. Most people who drink have driven after having only one or two drinks. They wouldn't want to be convicted for DWI for that. It is not illegal to drink a little and then drive, only to drive while legally intoxicated or when your BAC is .08% or higher.
