Not really. If there was the slightest bit of evidence of a crime having happened, the way was open to investigate, speculate and evaluate without fear of some sort of defamation suit down the road.

Otherwise people would not only not come forward with clues to crimes, they wouldn't report them ~ just take personal revenge as the opportunity presented itself.

The topic of the lineup has been discussed extensively. 'twould seem it wasn't necessarily improper. After all, you had a whole big bunch of guys who attended the party and who admitted they were there.

To demand that the cops pull in people off the street is pretty much like what TSA does when it subjects old ladies in wheelchairs to body cavity searches down at the airport while looking for terrorists.

What rock have you been living under for the past month?

It was a photo lineup. She looked at pictures. No one was pulled in off the street.

Don't the Durham police have pictures of people other than the lacross team?

How about pictures of the last 500 or so young white guys they have arrested?

They could have identified the single male source in one of two ways:

1. The police did DNA tests on her boyfriend/John(s) (unlikely I think) or

2. The single male source was already in the national DNA database (meaning he has previous convictions or has been tested for other reasons).

Probably the latter. The defense attorneys could have a field day with this guy if he turns out to be a John. They don't want to drag his name through the mud now, but just wait until the trial date gets closer. He is the key to dragging Mangum's sexual history into the open in a way that the rape shield laws can't stop.

While I think he should be called as a witness, I am not a lawyer. Any lawyers out there with an opinion?

My bet is that he is either her pimp or a john. A boyfriend would have been mentioned already.

What do we make of Nifong having the cabbie arrested and intimidated after he had this DNA report, but before he shared it with the defense? At some point his immunity from civil prosecution for doing his job ends if there has been enough malfeasance. It looks like one could start to make a case that his purpose in getting indictments was to advance his personal political career, rather than the pursuit of justice. Not that there was much doubt, but now we have evidence.

Wouldn't it be a grand project for the Duke law school to take on hounding Nifong for a while?

LIEfong is toast, and as this case continues to disintegrate, the black community in the area and possibly even Crystal Mangum will make him the scapegoat for forcing this case on the public. LIEfong was so adamant that dear Crystal had no choice but to go along. Besides, she was drugged by someone, remember? She was confused and coerced into a confession.

THAT would be most fitting and ironic for such a champion of diversity.

That is easy. LIEfong thought he would get the cabbie to retract his story. He also thought one of the players would flip once he leaked the now irrelevant unmatched sample under the Press-On nail. None of the above happened, so he delivered his turd of a DNA report to the defense at close of business Friday prior to a May 15th deadline. Now, he is in hiding until Monday where he may get a 3rd indictment in the secret (and biased) grand jury testimony.

LIEfong is crazy, corrupt, or both. Your choice.

Thank you for your thoughtfulness. I missed the Wonderful Mr. Cheshire's briefing. I was not in a position with access to any type of communications.

But late last night, I did put myself (or tried to) into the shoes of the AV's family, her supporters, the Racialist/Sexualist Academic Pinheads, the NBP -- to get a glimpse of how the facts in the light of day must appear to them now.

Yeah... "we believe you Anita Hill" has an eerie hollow echo this morning, no doubts (at least to the sane, it must).

Fact: We still don't know where the AV's missing highheel shoe is. And I know also with those who refused to acknowledge facts, there's a good chance this case is still not over. As in despite last night's facts and presser, I'm waiting for "the other shoe to drop". Again.

With the "dueling press conferences" it's clear that both side try to put the best "spin" on the news.

But that bit last night by the defense about the trash can with the fake nail in it just had me smiling and shaking my head.

I thought it didn't get any better and then he covered the swab from the "other man".

And we live in this state; Oh, boy.

I was so glad Mr. Cheshire spoke about Nifong "leaking" the results to the Press 3 days earlier, but only giving the results to Defense at 5pm on a FRIDAY.

Not to change the subject; but the frame-up pings me to another memory... A conspiracy theory about 9-11 and Jews by the usual racialist cabal.

And they'll have nothing to say about Nifong? Right. They won't.

For the past couple of weeks, the rumor here in Chapel Hill has been that her boyfriend (pimp) roughed her up after she failed to bring the $400 back. The story varied from he had sex with her to he used an object or both. She may have cooked up the rape story when she found herself at the PD since she was already in trouble with the courts regarding alcohol and substance abuse re: her kids.

If there is more than one source dna on the fingernails, and it is not cf or rs, then the case makes no sense. Leaving aside all the other ridiculousness, such as how cf and rs could orally, vaginally, and anally assualt the av and not leave any trace anywhere, the nails must then only contain DNA of the three alleged assailants and it does not becaue it has more than one. Either the Nifongnites would would have to claim that some of the dna was the result of casual transer but the dna of the attacker was not the product of a casual transfer (which is impossible) or there were more than three attackers. In either case, the story is hopeless, even apart from the dozens of other problems.

I was able to hear/see Cheshire's opening statement, but
Fox cut off the balance of the presser last night just as he was about to deliver the rest of the malfeasance of the prosecution. Did anyone get to hear all of it, or was it placed on WRAL's website? What a wonderful, pithy rebuttal.
