It would be a serious distraction once the kids find out but I'm not sure this is grounds for firing. But in this state (like in Georgia) you may not need grounds.

girls who work their way through law school as a stripper have the similar problem.
(actually there is some male lawyer in FL who has the same problem but he is a throwaway candidate put in to split the ethnic vote.)

So much for rehabilitation...
I note that there are no charges of current or recent criminal or even improper improper behavior.

"I'd say in her case, she's disqualified."
Take off her glasses, tell her to smile, and she might look a lot different. And possibly she has a figure that would compensate for the face, if taking off the glasses and smiling didn't work.

"Your presence in the classroom would cause a disruption to the educational process," McCracken County Schools Superintendent Tim Heller wrote in a letter to Dye. . . . after watching the video several times alone in a darkened room.

She just needs to head for Hollywood. She's on the same career track as Paris Hilton.

Talk about small-minded!
It was over 10 years ago, she's since served in the military and gone to college to become a teacher. Sounds to me like someone who did some dumb things (perhaps out of desperation) that were not illegal, got her life together, and is now being punished for her earlier (not illegal) mistake. I don't think this will wash, although if she doesn't yet have tenure, they can probably not rehire her. She may well have a good lawsuit, even under the ADA, over this.

What is just fascinating is this woman is fired for a one time thing she did 10 years ago when she was desperate for money and homeless....YET....that blond haired teacher queen in Tampa has raped two boys and is still walking in freedom.
I agree with the article where someone pointed out everyone has past behaviors and acts we would never want known. Yeah, this teacher had hers on video. Right afterwards, she tried to get her life in order. She joined the military and now is teaching school. She is bi-polar and hopefully is getting treated for it.
If she was trying to recruit minors at the school for her own porn flicks, or bedding minors like the Tampa harlot, I could understand this termination.
This isn't right.
Before it is brought up - yes, I would feel the same way if this had been a male teacher. People make mistakes and poor choices, especially when desperation sets in.

Remarkably dumb penalty in this case.
I wonder how the straight laced admin 'discovered' this moral infraction, anyway? :-)

My dad went to Reidland HS.
Not sure what to think about this. She didn't do anything illegal, and even thought it was distasteful and immoral, she does seem to think that it was a mistake. Given all that, and given the abscence of any crimes, it might be best to just let it go.
The only thing I'd be checking for is making sure the video didn't include any minors and that she didn't do anything inappropriate with any of her students while a teacher. If she did, then I'd drop the hammer.

"I fear there would be less than a serious approach to schooling by students who viewed the video or know about it."
And just how are these students suppose to "view the video?" Guess the Superintendent wants them to rush down to local adult video store and rent a copy.
Chances are they didn't "know about it" until you fired the teacher and made it "must-see TV" for every boy in the school.
Anyone want to take bets on how many times the Superintendent had to "view the video" before he made this decision. I say at least 3-5. I'm sure the Superintendent wanted to be positive it was her, after all it had been 10 years!
