That could apply one part of the Red Hat suit, the declaration of non-infringement, they're Red Hat's also suing for declaration of no misappropriation of trade secrets (SCO initially claimed trade secrets on Linux), false advertising, deceptive trade practices, unfair competition, tortious interference and trade libel.
