Someone once accused me of this very "logical fallacy" when I said "wait till they start suing fast food restaurants" in a debate about tobacco company lawsuits.
Quite frankly, I don't believe this is a fallacy. Throwing it out there doesn't negate the argument, which is a simply a the presentation of a logical next step. Heck, our legal system is based on precendent, as are regulations. Many things we used to think were 'absurd' have come to fruition.
Fighting terrorism to prevent a dirty nuke from going off in NYC is also "reductor ad adsurdum"
An important part of self-regulation is not ingesting things whose contents or effects can't be ascertained with reasonable certainty. And we already have plenty of laws prohibiting mislabeling, so we don't need a new law to go after herbal supplement sellers whose labels say they contain a certain substance and/or amount, and whose package contents contain something different.

Digitalis came from the foxglove plant
Some part of red yeast rice is also in cholesterol meds.
