The INS judges are administrative law judges, not district court judges. They have the laws and regs of the immigration system to rule upon. As such, they are administrative judges working for the executive, not the third branch of government. For example, when declaring yourself a target of political repression, the ruling before was you go to the nearest country where you are not prosecuted...you did not get to decide gee, I am here in the Congo and I want to go to NY.

We took in almost 1 million H1B visa holders in the last year. Each one took an Americans job. Did you know that 1000 of them work for the Baltimore City School System? They are not teaching the kids. There are only 7000 employed by that school system. There are dozens of crazy examples like that.
That’s what these courts are for.
