Is it finally lights out for the Council on American-Islamic Relations?
Rep. Jason Smith (R-MO), chairman of the Ways and Means Committee, has sent a letter to the Treasury Department and IRS calling for scrutiny of the tax-exempt status of the Council on American-Islamic Relations (CAIR) and its California chapter—citing evidence of prohibited election interference that I detailed in May 2024.
Rep. Smith’s letter primarily focuses on the California chapter of CAIR, which was accused of improperly applying for and spending $7.2 million in federal taxpayer money granted by the state of California.
However, the letter also draws attention to “CAIR’s apparent intervention in the Presidential campaign by endorsing and sponsoring a ‘Protest Donald Trump’ rally at the annual Minnesota Republican Party Lincoln-Reagan Dinner.” Included in the evidentiary evidence are excerpts from another article of mine from Capital Research Center highlighting the event and other potential IRS violations by CAIR.
About CAIR
CAIR was founded on the national level by the U.S.-based wing of the Muslim Brotherhood, an Islamist organization that created Hamas as part of a staged plan to covertly infiltrate, influence and ultimately dominate the Western world. Does this sound like an organization that should receive tax-exempt status to you?
“From its founding by Muslim Brotherhood leaders, CAIR conspired with other affiliates of the Muslim Brotherhood to support terrorists . . . the conspirators agreed to use deception to conceal from the American public their connections to terrorists,” federal prosecutors testified in a court filing in 2007.
Critics of CAIR were vindicated after the October 7 attacks when its executive-director, Nihad Awad, celebrated the attacks at a recorded event. The video was then taken down as CAIR ridiculously tried to pretend Awad was only praising non-violent Gazans who briefly trespassed onto Israeli land. The Biden Administration condemned Awad’s remarks.
Texas Governor Abbott designated CAIR and the Muslim Brotherhood as foreign terrorist organizations and transnational criminal organizations. On February 5, Texas Attorney General Ken Paxton sued CAIR and its Texas-based chapters with the stated objective of “prohibiting the organizations and their affiliates from owning property in the state or soliciting or recruiting members.”
CAIR’s Election Interference
The IRS makes it very clear.
“Under the Internal Revenue Code, all section 501(c)(3) organizations are absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office. Contributions to political campaign funds or public statements of position (verbal or written) made on behalf of the organization in favor of or in opposition to any candidate for public office clearly violate the prohibition against political campaign activity. Violating this prohibition may result in denial or revocation of tax-exempt status and the imposition of certain excise taxes.”
There have been at least three separate instances calling CAIR and its chapters’ compliance with this rule into question.
1. “No Trump! No KKK!”
As cited by Rep. Smith, CAIR’s Minnesota chapter endorsed an anti-Trump protest in May 2024 during the presidential campaign. The chapter amplified a graphic with its logo and those of two partnering organizations that simply says, “Protest Donald Trump.” A second post with a different graphic promoting the protest says, “No Trump! No KKK! No Racist USA!”
The purpose of the protest was to condemn the Minnesota Republican Party’s Lincoln- Reagan Dinner’s hosting of then-presidential candidate Trump. Is that not a statement of opposition to a political candidate and an effort to influence the election?
Notably, CAIR-MN’s partner in organizing the anti-Trump rally was the Minnesota Immigrant Rights Action Committee, which I recently exposed on the Glenn Beck Program. MIRAC receives donations via its c 501(c)(3) nonprofit named Minnesota Immigrant Rights Action Committee Education Fund. MIRAC’s tax-exempt status could also potentially be at risk as well.
2. “Mobilizing” for Biden
In January 2024, when CAIR’s national organization published a social media post that quoted the executive director of CAIR-California’s Sacramento Valley and Central California chapter as saying, “Our community mobilized to put Biden in power after [former President Donald Trump].”
3. Attacking Ben Carson
The third incident is the most blatant. It occurred in September 2015 when CAIR formally demanded that Dr. Ben Carson end his campaign for the Republican presidential nomination because he said he would not support a Muslim for president. Carson then clarified that he was only referring to Muslims who believe in instituting Islamic law.
“We ask Mr. Ben Carson to withdraw from the presidential race because he is unfit to lead because his views are in contradiction with the U.S. Constitution,” CAIR Executive Director Nihad Awad told the media.
It is hard to see how CAIR could deny that its stance is in violation of the IRS’s prohibition of “public statements of position (verbal or written) made on behalf of the organization in favor of or in opposition to any candidate” by 501(c)(3) nonprofit organizations.
This wouldn’t be the first time that CAIR had its tax-exempt status revoked.
It happened in June 2011 as part of an IRS action against about 275,000 nonprofits that failed to meet the requirement to file their annual 990 reports three consecutive years. It was reinstated roughly one year later.
The IRS has the power to revoke the tax-exempt status of extremist nonprofits like CAIR and MIRAC. Why isn’t it using it?
