My follow-up question would be this: if there is such a thing as an "independent" agency, then what authority would this agency answer to? Where is their system of checks and balances if not the Executive Branch? Surely they cannot function in a total vacuum, answerable to no one, right?
Maybe we'll get the SCOTUS answer on this in the coming couple of weeks... if Roberts doesn't weasel the Court out of this issue.
