Courts revoking permits for oil and gas projects creates chilling effect on investors, experts say

Two recent court decisions could have far-reaching impacts on oil and gas projects.

The Sierra Club, the Center for Biological Diversity, and other anti-fossil fuel groups recently sued the National Marine Fisheries Service, claiming the agency’s “biological opinion” failed to properly assess the risks that offshore oil and gas drilling poses to endangered species.

Last month, U.S. District Judge Deborah Boardman ruled in favor of the plaintiffs.

Hopefully using the recent Chevron Decision, the Supreme Court will take this case and overturn the ruling.

What surprise! “Boardman, who was appointed by President Joe Biden, vacated the assessment entirely. This means that new permits and leases for drilling canot be issued until a new biological opinion is published. The decision may also void existing ones.”

The dems are establishing political risk as a cardinal point of business planning. Companies can work the process, dot the it’s and cross the t’s, get all required permits in heavily regulated fields, and proceed in good faith with billions of dollars in investments ... and while all corporate obligations are binding, none of the government permits are worth the paper they are written on. This is the abolition of the rule of law, as is retroactivity in regulatory and court decisions.

Owning the politicians and controlling the activist groups through large grant’s are the only safe harbors. Corruption become the only ways to achieve reasonable certainty. To corrupt pols, this is a feature, not a bug.

Just make sure you personally have secured access to potable water, a decent store of food and a few years supply of heating materials.

We’re specifics provided? Will the court define what is “properly”? Either they complied with the law or they didn’t. If they didn’t then how? If they’re told how then it should be a trivial matter to resolve.

Somehow, I don’t think the law will be followed.

Yep... Their activism roots go back to the 1800s when the Chinese were persecuted against and pushed into indentured servitude in Frisco. Ironically by the unions and other Democrats... They have been in a secret partnership with China for a long time and receive a lot of funding from them.

As I have said, they don't need to. There are other ways to shut down the oil industry.

But "Bird Choppers" also known as wind farms are okay. If I kill an eagle the following can happen:

Under the Eagle Protection Act, wounding or killing an eagle can result in a fine of $100,000 and one year in prison for a first offense, according to the U.S. Fish and Wildlife Service. A second violation is a felony and carries heftier punishments.

If a Bird Chopper kills an eagle there is is rarely a penalty. There are laws on the books but rarely enforced.

How long has there been oil drilling in the gulf? And just now it is a problem? I am sure Mexico is going to stop with great concern of “endangered species.”
