A Hessian soldier with no diplomatic immunity is within that jurisdiction — though if fighting colonists there is no US at all at that time and the whole question is moot.
The child born to the Hessian is as much an NBC as would be any other child born when there was no US yet in existence.
It is bizarre this argument persists on FR. If you’re born on US soil to parents who do not have diplomatic immunity, you are born within US jurisdiction on US soil and there is no further discussion warranted.
If the parents are residents of Mars, it does not matter — provided they did not submit Martian diplomatic credentials exempting themselves from US jurisdiction. It does not matter. The child is not responsible for any crimes the parents committed.

It is bizarre that after so *MANY* discussions of this topic on Free Republic, that there are still those of us who don't understand that 14th amendment citizenship is not *NATURAL* citizenship. It is in fact a "naturalization."
Don't believe me? Read the actual debates on the 14th amendment. The people trying to pass it through congress *TELL YOU* that it is a "naturalization" process.
They were trying to give citizenship to freed slaves who were already born here. They wouldn't have to give it if it were already natural.
Giving citizenship to non-citizens is naturalization.
The 14th amendment did not re-write "natural born citizen." It created a new naturalization process. That's it. That's all.
