Wouldn’t the act need to get 60 votes in the Senate to overcome a filibuster? Hard to believe Dems would allow this to pass, so the veto threat is kind of meaningless at this point.

Quite the opposite. The veto threat allows vulnerable dem senators to vote for the bill knowing it will never become law.
