Not exactly. The Illegal Immigration Reform and Immigrant Responsibility Act of 1996, explicitly prohibits noncitizens from voting in federal elections. It is not legal in any state for a noncitizen to cast a ballot in a federal election. So separte the twins. The law is already in place.
The problem is the one you eluted to in that it is not the rule but the enforcement. And that has to be done at local level and hasn’t. I’m a firm believer in having two votings. One for local politics and reprentatives (state), and the other for federal determinations. By doing this they can stay within the existing laws and not effect the outcome of federal electiond by watering down the count with non-citizen votes. What they do in their area is their business. As long as they keep the vote clean and legal at the level that effects everyone and within the laws for federal elections for the federal election vote. Then everything is lawful and up front. And while they are at it, put some meat on the law by establishing punishment to the malfeasance and to the illegals that voted...and enforce it.
