Judge Expunges Convictions of St. Louis Couple

The St. Louis couple whose photo was seen around the country during the Black Lives Matter riots of 2020 had their record expunged this week, the St. Louis Post-Dispatch reported.

Attorneys Mark and Patricia McCloskey filed a request in January to have their convictions wiped and their law licenses restored following a misdemeanor fourth-degree assault charge in 2021. The couple also demanded the return of their guns.

Judge Joseph P. Whyte wrote in an order on Wednesday that the purpose of expungement is to give people who had rehabilitated themselves a second chance.

He’s not stating the original sentencing and punishment was wrong. Not truly giving them justice.

Fourth degree misdemeanor? What is that, the equivalent of a parking fine? To have your life turned upside down and your profession taken away? Justice? Just BS in this country now.

Rehabilitated? The couple was never debilitated in the first place, they were making the perfectly normal response to an attempted home invasion.

The “castle doctrine” is a valid basis for home self-defense.

I remember reading of a man who had a fully registered and licensed and legally owned Thompson submachine gun in mint condition. The police raided and confiscated it.
After several years of legal wrangling, he got his submachine gun back , rusted up so bad it was wothless.

Not sure that is correct. An expungement directs the court to treat the criminal conviction as if it had never occurred which technically removes it from a defendant’s criminal record as well as the public record.
