The Prosecution can obviously have n actual evidence of the deed being done mush less that it was a crime were it done. But the Judge who is acting as the second prosecutor in this case can hand it to the Democrat jury with Instructions that hint at the desired verdict. The jury may all already know that their fortunes will be enhanced with the “proper” verdict.
