California Ammunition Infringements Back in Force… for Now

Californians have been free to purchase ammunition, much like the rest of the United States, from January 31, 2024 to February 5, 2024. On February 5, 2024, a three-judge panel of the Ninth Circuit, in a split decision, granted a motion to stay the decision of the District Court by Judge Benitez. Judge Benitez found the ammunition law to be unconstitutional for a second time.

In 2016, voters in California approved a ballot measure known as Proposition 63. The proposition created a system where gun owners would apply for an ammunition permit, which would cost $50 and be good for four years.  Ammunition vendors would be required to check a California list of valid permits before approving a purchase.  This system never went into effect.

Before the election day, when Proposition 63 was voted on, the California legislature enacted Senate Bill 1235. The bill changed and eliminated Proposition 63, and put Bill 1235 in place. Bill 1235 required a background check every time ammunition was purchased, along with numerous other requirements, fees, and prohibitions. Bill 1235 was to go into effect on January 1, 2018. The bill was challenged in the courts as unconstitutional on April 26, 2018.  On April 23, 2020, Judge Benitez issued an order granting a preliminary injunction to stop enforcement of the law. On April 24, 2020, a three-judge panel granted a stay on implementing the preliminary injunction.

On June 24, 2022, the case was sent back to Judge Benitez to consider the impact of the Bruen decision at the Supreme Court. On January 30, 2024, Judge Benitez issued an order granting a permanent injunction to stop the enforcement of the unconstitutional ammunition law infringements. From the order:

The argument is made that only the good Californians are leaving and that they will not vote leftist in there new home state.

The problem is they are so brainwashed they do not know they are leftist oriented. My sister that lives there as well as others I have known have a leftist mindset. They can’t help it. They learn it in school, it’s blasted at them in their hometown news, they adapt to it in their culture.

It’s natural for them to want to save the planet, save all the animals.

My sister claims to be a Republican. In my state, with her view points, she’d be a solid leftist. She shames Trump for inciting the J6th insurrection. She believes the ocean can rise due to global warming on one beach, yet not another several miles down the road.

A few years ago a Calif transplant visited us while I was building a boat ramp. I was asked if I had an environmental impact study done. I said no. The guy about went ballistic.

Another example was at an eatery where I made a remark to a waiter, who proudly said he was from Calif. My remark had to do with the quality of food. I was told not to be judgmental.

This is the crap they bring with them. They cannot help but vote democrat.

Understood. I still think they can wisen up. But it takes effort and yes, they don’t tend to start working at any self- improvement since they’re brainwashed into believing they’re perfect and it’s the world that needs to change

It may be prohibited by California law but nothing to prevent someone from loading up on ammo at a Az or Nevada gun show!

There are documented instances (you could probably look them up on Calguns) of Cal DOJ agents cruising the big Reno gun show taking note of CA plates in the parking lot. Later cars were pulled over after entering CA. So if you do go, park away from the show and Uber in.

that is a myth and needs to stop
its all the trash that has moved into cal in the last 30 yrs plus all the students that come here to college with leftard voting.
