Government attorneys are known for overwhelming the opposing party with truck-loads of white paper. A small firm, especially in a case with short deadlines, doesn’t have the time, manpower, or money to inspect every document dumped onto their front stoop. Clerks and interns do not have the know-all to see if the documents they are reviewing are relevant to the case or not. Government lawyers will misnumber or misfile documents in responsive documents so that the smoking gun document will never be found. If caught, they can blame it on a clerical error or say the document was in box #249 in the documents provided. It may be paper-clipped to and in the middle of another unrelated document, but it was there.
