Did they destroy the records after consultation with Trumps Special Counsel? Did he give suggestions on which to keep and which to destroy?
I think a penalty would be applicable if Hack Smith knew of the evidence abd either destroyed it himself/staff or knew that J6 Committee was going to destroy it. He’s a lawyer representing the people. This is likely exculpatory evidence. In a just world, he’d be disbarred

My understanding is that it is the actual interview that is missing, along with much more evidence.
The fact the evidence is missing (being hidden, more likely destroye) is enough. Jack Smith isn’t a legit Special Prosecutor and should be disbarred for that fact alone. As a lawyer, he should know better.

I think you mean that dems probably rejected some of the testimony for their "report." The problem is that AFAIK we don't know exactly what is missing.

No, they deleted or destroyed it.
That is the most likely cause, although some of them could be misplaced. But how do we determine which testimonies, or testimony fragments, did NOT go into the J6 report? My guess is, you obtain a record of all witnesses who appeared, and subpoena all of them to verify that the J6 report's witness videos are complete. Dems and RINOs will scream "national security" but I believe that using that excuse would be unconstitutional.
