The settlers of the American West and the Iroquois Confederacy had their own concept of property rights enshrined into law centuries before European settlement.
The biggest problems were that (1) the indigenous concept of “Trespassing” conflicted with the European concept of “Squatters’ Rights”, a conflict that not even the British Empire fully understood when it signed treaties, in good faith, with every indigenous nation that they encountered in the Americas.
