On June 30, the Supreme Court handed down its decision in Biden v. Nebraska, the case that challenged the legality of the president’s executive order cancelling federal student-loan payments for millions of borrowers. In their ruling, the Court’s majority held that the president had no authority to declare such a cancellation. The statute that the administration had relied upon, the HEROES Act, could not be stretched, the Court decided, to mean that the president had been empowered to make a sweeping loan-forgiveness decree. Nor does anything in the Constitution give the president such authority.
Thus, Biden’s loan-forgiveness plan was struck down as legally invalid.
The Biden Administration, however, is not one to let mere illegality stand in the way of anything it sees as politically advantageous. The same day that the Court issued its decision against executive action to cancel student loans, the White House released a fact sheet entitled “President Biden Announces New Actions to Provide Debt Relief and Support for Student Loan Borrowers.” Under this new initiative, the student-loan debts of some 3.6 million borrowers will be wiped out, costing the Treasury approximately $175 billion.
The obvious question is how these “new actions” can be legitimate if the president’s previous order was not.
Under the new plan, the Department of Education is crediting student borrowers who did not make their monthly payments during periods of “forbearance” with having actually made their payments. Here’s the background.
Borrowers who find themselves in difficult financial circumstances can ask that they be permitted not to make their monthly loan payments, and such periods are called “forbearance.” Federal law clearly allows this, and many borrowers have taken advantage of it. The law does not, however, say that months of forbearance can be counted as months in which payments were made.

The problem is that since 1995 when the legislation was first passed the subsequent administrations both Dim and GOP have allowed the DOE to screw up counting the payments that many borrowers have been made.
The Biden administration saw there was a problem and looked at the political advantage to them of “fixing” it.
Additionally, the article mentions “standing” as a problem. This is a legal tenant will not change, unfortunately the Congress critters refuse to do their job and ensure taxpayers don’t get fleeced.
“The standing-to-sue requirement has blocked many suits by taxpayers against unconstitutional spending, because the courts have decided that it isn’t a sufficient injury just to show that some of your tax money is being spent illegally.”
The Democrats know how to work the law to win.
My kid just started college. We have the ability to pay for it but took out a loan for it. If they’re forgiving loans might as well join the pack.
If my kid doesn’t have to pay back a loan for education, that money could be used as a jump start. Maybe a down payment in a house. My goal is zero debt for my kids when they exit school. Something I didn’t have.

The Democrats and Republicans set up sweetheart loan systems paying lenders big interest. We have 7% loans put in place when the interest on other long term debt was running 4% to 5% for loans not on property.
Then the Democrats, seeking votes, started teasing and teasing all sorts of “forgiveness” programs. To make it worse, the Covid scam was used to stall repayment requirements allowing interest to build for those who took advantage of such deals.
Now these young people have been told the Bad Republicans and their Judges are “making them pay high loan balances” when it is the stupid loan programs they sucked them into that are “making” them pay.
Universities with administrators and academics are making record salaries and record retirement programs. Anyone remember when professors had nice lower middle-class incomes with summers off? Now they are money machines thanks to politicians.
Will the young voter feel resentment toward the Democrats? We are not realizing how ill educated they are and isolated from clear thinking.

I’m pretty sure FJB has figured out that if he pays off their loans, all the Millies and Zero Gs will move to Europe, Asia or some other foreign country “for adventure, excitement and free college.” (I was reading about these jokers, The Expatsys yesterday). LOL! Real jerks.

Constitution states Congress controls the purse strings.
There must be a squad of lawyers working on this for the white house. They’re trying any which way to get it done. It’s called manipulation, it’s called the workaround, it’s called we want it our way... when the Constitution says different.
Is the Democrat Party way. The workaround... at taxpayers expense.
Congress just needs to attach legislation to one of the must pass appropriation bills making ALL Federal Employee’s liable for any and all debts forgiven by the executive branch. Attach their Wages and Assets to pay for this Illegal Act.
