Nah, because they could charge him with some other crime besides the misdemeanor they are charging him with, and double jeopardy would not come into play.
But I expect that part of the plea deal will be that he receives immunity from further prosecution for anything the feds know about that he did that day. So even if Biden loses, that deal will remain in place and tie the hands of the next people in charge of the DOJ.
Thinking they’ll cite Epps’ juciest acts and then just tank the prosecution, resulting in a Not Guilty verdict, giving Epps reliable protection from future prosecution based on a theory of Double Jeopardy. OTIH, this kind of corruption might be hard to coordinate with Epps’ attys and to then pull off the scam before a federal Article III district court judge.
