Because there isn’t a decision to review. The court can’t take hypotheticals. For example, while extremely unlikely, the jury “could” acquit Trump, or the judge “could” throw prosecutors’ evidence out. So the USSC and appellate courts must wait until they act.

I suspect because he is the leading political challenger to the current Executive and he is a former President, any sentence will be fast tracked to SCOTUS to stay the sentence pending appeals. Everyone is talking prison, but convicted or not Trump has Secret Service protection 24/7, I cannot see the Secret Service allowing him to be imprisoned. He would have to be placed in solitary confinement with Secret Service present 24/7. This was mentioned in an earlier case when someone began crowing over Trump in prison, I believe the NYC case. It was pointed out everything will have to be approved by the Secret Service and they will not allow the standard processing nor any confinement. Sure enough it was reported that Trump did not have to go through the standard arrest procedures.

Smith has a problem in Florida, one jury member in a Red State could kill his case, He needs DC to get a conviction. While this Judge is a bitch, will she go along with this knowing she will be slapped down hard by SCOTUS? Her future as a judge and her reputation are at risk. Sending a protestor to prison is one thing, violating Trump's free speech could be grounds to remove her from the bench.
