If you listened to the government, you would believe that the operation went like this:
Social media companies couldn’t handle all the moderation they had to do. They didn’t want harmful “misinformation” or even *gasp* “malinformation” on their platforms. They kept identifying what they considered dangerous untrue posts that threatened the fabric of society. They even identified true posts that would scare others, and those were worse. People were discussing COVID vaccine side effects, and it started spreading. The social media companies were invested in ensuring that every American felt comfortable getting a shot in the arm, no matter the cost.
Understanding the platforms were overwhelmed, the government stepped in. They worked in tandem with Meta, Twitter, Google, etc., in a symbiotic relationship. The government just wanted to help, you see. So they set up a sprawling public/private conglomerate to act as these organizations’ “Trust and Safety” department. After all, they couldn’t handle it on their own, and the government wasn’t doing anything but alerting social media companies when an unsuspecting citizen stepped out of line and posted wrongthink.
That is the line of garbage the government has force-fed to the media, congress, and the courts over the past year and some months as the Missouri v. Biden case has charged forward. They claimed it again as recently as last week as they filed their appeal to the temporary injunction Judge Terry Doughty slapped on them in the case.

The panel is Judges Edith Brown Clement, Jennifer Walker Elrod, and Don Willett. Recall that this is the expedited appeal of the July 4 injunction that barred various federal departments from encouraging social media platforms to delete certain content.

The left certainly seems appalled by the judges on the panel.

The Court ordered the government involvement in censorship of media to cease. It will not cease. The government’s role will become more discrete and there will be several more layers between the government and the censorship. The government has absorbed most of social media into itself along with the Tech companies and the MSM. The government now just has to put up misinformation items on some bulletin board without labeling them and the Department of Communication .e. YouTube, Meta, Google et al will follow through. The symbiosis is firm enough that for the most part notice need not be even given.

Correct. They will devise a workaround. The universities will do the same with affirmative action.
It impacts the ongoing assault by our government against our most fundamental right -- free speech. It is couched by the government and their friends as "misinformation, false information, and conspiracy theories." And it is the biggest tool in their arsenal to control our thoughts -- it's called propaganda and censorship. And they do it extremely well!
All government actions and abuse flow from this action.
The Fifth Circuit Court of Appeals is likely the only court left that will come down on the side of stopping, or at least slowing down, this rampant abuse of this right by our so-called government.
I predict the Fifth Circuit will come down on our side, and this will end up at the US Supreme Court, where it may be as monumental as abortion and affirmative action, which finally came down in our favor. That is unless one of the judges dies in their sleep at a hunting lodge, is killed in the middle of the night by a robber, or wanders into a local DC park and blows their brains out.

They hate Judge Willett with a passion. Judge Elrod, I believe, is the judge that said a tax for not buying insurance was unconstitutional. Judge Clement-Brown is considered a conservative, constitution-supporting judge of whom the leftist media often writes hit pieces.
So, all in all, a good panel to hear this appeal.

I have no problem believing that one of those options listed in your final sentence is in the works as a “break glass” solution should the Court keep insisting on ruling against the deep state on major issues.
