House Votes to Nullify ATF Rule on Pistol Braces, Senate Votes to Keep it

On June 13th, 2023, the U.S. House of Representatives voted to overturn the proposed rule of the BATF, which is set to make the possession of pistols with a pistol brace installed a federal felony, punishable with up to a $10,000 fine and or ten years in prison. The vote was almost entirely on party lines, passing 218 to 210. Two Democrats voted for the resolution, and two Republicans voted against it.

On Thursday, June 22nd, 2023, the Senate voted against  H.J. Resolution 44 by a razor-thin margin of 50 to 49. Three Senators, who were considered possible swing votes, voted against the resolution. Two more votes would have been necessary to pass the resolution. Vice President Harris would have almost certainly broken a tie vote against the measure. The three swing votes were Senators Tester from Montana, Manchin from West Virginia, and Sinema from Arizona. Senators Baldwin (D-WI), Brown (D-OH), and Casey (D-PA) were candidates to vote for the measure because they will be coming up for election in 2024. All voted against it.

The vote was for House Joint Resolution 44 :

Resolved by the Senate and House of Representatives in Congress assembled, That Congress disapproves the rule submitted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives relating to “Factoring Criteria for Firearms with Attached ‘Stabilinzing Braces'” (ATF final rule 2021R-08F), and such rule shall have no force or effect.

The ATF rule reversed a decade of ATF policy where they assured purchasers and manufacturers of pistol braces such items were legal and not regulated by the NFA.

Wyoming Congresswoman Harriet Hageman voted for the resolution. From her office:

“This latest unconstitutional rule from the A.T.F. is a blatant attempt to take away our 2nd Amendment rights and strip away the ability to
defend ourselves”,

The whole system of restrictions on short barreled rifles and shotguns is irrational and unconstitutional.

This was the ONLY point in bringing this to a vote, as it has always been obvious that Biden would veto and that it couldn’t possibly be overridden. Now these people are exposed, and if their opponents are smart, they’ll blast them over it, repeatedly. When the Supreme Court strikes down this rule (and it will), then these people have supported unconstitutional acts by an out-of-control agency.

One of the points that Kennedy brought up was that agency changed the law without a vote of Congress, and that a vote of Congress seems to be necessary to overturn what a bunch of unelected bureaucrats did. He decried the idiocy and unconstitutionality of that fact. This is why I fully believe that the Supreme Court will overturn this rule. It is not only a violation of the second amendment, it is a violation of the separation of powers. The executive, of which the ATF is a part, cannot make law.

Personally, I like the Constitutional requirement that the House of Representatives is responsible for creating the federal budget.

The simple solution is to no pass any future continuing resolutions and to hold hearings into cut backs on FBI, ATF, DOJ and other rouge Departments proposed budgets.

All that work getting elected, getting sessions going, etc.

Then flunkies from ATF break out a #2 pencil and create a nation of felons.

When called out on it bills are crafted that were never needed, congressional votes are held that are just wasting time.

All because some wailing jerk-off prog was playing with a pencil and got the word from the neo-communists running LGB to get in there and screw up everything.

It's almost like they want everyone to think about some juvenile BS created by a bunch of goofs that were not good enough to get into DEA, instead of what the "first" family is up to getting bribes from the chicoms to sell out normal American Citizens.
