As long as they are paying him he cannot sue for breach of contract I would think. Keeping him on the payroll prevents him from going to another venue and presumably taking his viewers with him. Not a bad strategy from a business point of view since they would likely have to pay the remainder of his contract anyways if the fires him outright
I would be very surprised if it prevented him from speaking out on the issues.
This could lead to the very interesting situation of Tucker being paid by Fox to say things that Fox would prefer him to not say...
