So? The commenter quoted didn’t say it was in a “Founding Document”, he said it was in the Constitution.

Right. Because the constitution didn’t exist when the declaration was signed doesn’t mean the declaration disregards the constitution. The constitution is just one possible resultant government the declaration claims as a natural Right. I’d submit therefore the declaration is the superior of the two.
