Years ago when I worked for the DEA, we enlisted UPS to try and intercept shipments of drugs. Very soon we learned that those intercepted packages were subject to Fourth Amendment restrictions because even though the search and seizure were private, it was Government instigated. Sharp defense counsel got the drugs suppressed from evidence. Why this same rule doesn’t seem to apply to other amendment violations being performed by private industry at the behest of the Federal Government beat the heck out of me. Perhaps it is that there are no longer any uncorrupted judges.
