True, Trump was never indicted or convicted of “insurrection,” but the 14th amendment is vague on that point—it is obviously intended to exclude men who had supported the Confederacy but doesn’t specify that such people have to be convicted in a court of law.

Then the rest of the constitution kicks in and preserves the rights of the individual until proven guilty.

In our Republic we have rights that government cannot take away without a fair trial.
