She's being discriminated against (treated unequally) for her medical choices. And it's endangering her life.
There has to be some legal claim there.
I'm also sure that some kidney donors are unvaxxed, and might not have signed a donor card if they knew the unvaxxed would be discriminated against.
Thank you for your response. I do not see a medical reason for a covid vaccination prior to transplant based on the evolution of the disease. However the defense against a lawsuit arguing discrimination is that the patient is not compliant with transplant center protocols. The on point analogy is that a liver failure patient is not going to be transplanted without alcohol cessation. This discriminates against alcoholics.
Additionally transplant is inherently high risk. I don’t think a one can argue as others have that because of the high risk of vaccination (not proven but argued) it cannot be required. As transplant has higher risk of mortality than vaccination it would not pass a balancing test.
Regardless of opinion, it’s the difference between what one knows and what one can prove. The majority of literates says covid vaccination is safe. That is the evidence that is going to be introduced. So I don’t see how a legal challenge works for her.
Most transplant centers recommend covid vaccination but some don’t make it mandatory. Perhaps the person here should seek transplant care at a center not requiring covid vaccination. If enough patients did this then the market would dictate centers would re-evaluate the covid vaccination stance based on loss of revenue. The free market system always works.
Those who don of understand history are condemned to repeat it. There is scientific credence that the covid vaccination prevents severity of disease. I will absolutely freely state that it is not 100% efficacious at preventing infection. Clearly it is imperfect as a vaccination as most are. It does not exclude that there are benefits. There are data that establishes some benefit and people should evaluate it for themselves and decide.
I see no need to vaccinate relatively healthy people against omicron or other evolving strains as they will continually be more contagious but less dangerous.
I think politicians were entirely tyrannical in their handling of mandates and the pandemic at large. But Hitler arose to power on the notion of pure blood. Once someone believes that they are superior to others based on purity — that is a population that can commit holocausts.
I would suggest that those who claim superiority status are far closer to totalitarian control than those like me in medicine who see it for what it’s worth. I don’t disagree Fauci showed us medical tyranny but the only way he could have was by manipulating the levers of power in which politicians could pass laws and orders. Without the ascent of politicians, Fauci would have simply been an irrelevant idiot. He is a complete sociopath.
What is disturbing is that many of the pure bloods are also calling for people to “swing from the rope” without due process or diligence. They have booth into their own superiority and now are transitioning to believing they are infallible on knowledge.
As you recall I have been called a Fauci acolyte. It is untrue. All it would take is 17 seconds of research to find I am adamantly against mandatory vaccination and covid vaccination for young people (by young i mean under 30). Anyone who thinks a 5 year old needs covid vaccination is incapable of seeing the virus for what it is. They are idiots.
It is chilling that people would use a phrase from Mein Kamph seriously and believe it about themselves. You don’t see the problem with this?

First. You are your own first responder. You also should be your own GP and medic. Of course that doesnt mean youmdont have an actual doctor or go to the er. Its just a mindset to be actively involved and know how to care for yourself.
Second some doctors are also doctors that continue studies and become naturopath doctors. They are aware of more than just whipping meds at symptoms or slicing you open. They are more like classic doctors who try to actually determine and correct the problem. Look for these types of docs. They have more in their arsenal than just prescriptions and organ removal/surgery. It may come to that but they don’t automatically go there.
I don’t see a problem with the truth.
