Konnech is the company that has been caught running election data streams to Chiner.

This goes well beyond True the Vote — somebody in the Deep State is in CYA mode, and this judge is playing ball.

If I’m reading that correctly the 2nd name the judge wants is an FBI confidential agent. Couldn’t the judge request that name from the Feds?

In a criminal case, yes. This is not a criminal case. It’s a civil defamation suit, filed by the software company (Konnech).

(Which also means that the DOJ is not a party to the suit.)

Here’s where it gets tricky and technicalities matter.

TTV is making a claim that the individual is a confidential FBI informant. That really can’t be verified without his/her name, or at least some identifying information about him/her. It’s kind of difficult for the Feds to confirm or deny someone’s status without knowing who the someone is.

Secondly, the FBI is not in the habit of “outing” its informants. If they did, they wouldn’t have any informants.

But would they to a judge if they knew who? Time and location apparently are known which might be enough for the "whom" part.

That’s a very good question. I don’t know the answer.

I do not know for sure, but it’s easy to imagine that somewhere in the history of the FBI there’s been an issue of the courts compelling (or attempting to compel) the FBI to confirm/deny information about it’s operations. If that has happened, I cannot say definitively what the results were. It sounds like a separation of powers issue (judicial vs. executive).

However, it IS standard practice that the FBI doesn’t confirm or deny the people in its operations. They won’t even deny, because if they deny even once, then any refusal to deny becomes a confirmation.

Given that the FBI does have this practice, my assumption is that if there ever were such a test of these separation of powers, it would seem that the FBI retained its ability to keep its employees and operations secret.

The 5th amendment is always about specifics and context and coercion by government officials except for judges, who get to decide whether your 5th amendment claim is valid and they can hold you in contempt for refusing answers that they deem necessary to the matter at hand.

True the Vote isn’t making 5th amendment claims, they are making freedom of the press claims in protecting their source.

This is a defamation suit to which truth is an absolute defence. I don’t think the source of true information matters. Konnech should be able to demonstrate the falsity of data without knowing the source. Their demand to know is a bogus attempt to identify a whistleblower.
