“You Can’t Have Your Cake And Eat It” – Special Master Raymond Dearie Blasts Trump’s Lawyers in Preliminary Conference

Judge Raymond Dearie, the “special master” appointed to review the ‘classified’ documents seized from Mar-a-Lago blasted Trump’s lawyers at Tuesday’s preliminary conference.

Judge Dearie was one of the FISA judges who signed the warrant to spy on Carter Page without cause. ...... Snip......

On Tuesday Judge Dearie repeatedly asked Trump’s lawyers to prove the former president declassified the documents stored at Mar-a-Lago, “You can’t have your cake and eat it,” the judge said according to Politico.

In a new filing Trump’s lawyers argued that the DOJ has never actually proven the documents it claims are classified are actually classified.

“The District Court denied the Government’s stay request, noting it was not inclined to hastily adopt the Government’s contention that the approximately 100 purportedly “classified” documents were, in fact, classified, and that President Trump could not possibly have a possessory interest in any of them.” Trump’s lawyers wrote in the 40-page filing

Politico reported:

The senior federal judge tasked with reviewing the materials seized by the FBI from Donald Trump’s Mar-a-Lago estate sharply questioned the former president’s attorneys Tuesday during their first hearing before his courtroom.

Judge Raymond Dearie pushed Trump’s lawyers repeatedly for refusing to back up the former president’s claim that he declassified the highly sensitive national security-related records discovered in his residence.

“You can’t have your cake and eat it,” said Dearie, the “special master” picked by U.S. District Court Judge Aileen Cannon to vet Trump’s effort to reclaim the materials taken by federal investigators.

Trump’s lawyers are not just refusing to provide a declassification document.

They are refusing to provide any explanation of the declassification.

We can rail against the judge all we want, but Trump has been given every chance here.

The Trump team is being embarrassed. It was either bad lawyering to ever assert declassification, or it’s bad lawyering not to back it up.

Yes you can say the DOJ has to prove its case at trial, but for purposes of this hearing the special master has to be convinced of something, or what’s the point of this hearing?

I suppose they will still get the special master to review the documents.

How can he prove they were unclassified without knowing what the DOJ has?

Besides if they were in his possession they were declassified.

They are tap-dancing on the issue and no one wants to stick his law license on something Trump said he did. I am beginning to believe that that they don’t have the paperwork for these files.

a standing order is usually written down once at least...

but a president taking files home can be assuming he is declassifying them. but assumptions in law are bad.

Trump’s lawyers should very publicly call him out, make him answer questions about his role in the FISA fiasco....

President Trump agreed on the selection. I honestly believe they thought - logically - that he would have learned a lesson from his FISA experience, namely that SOP of taking the Feds' word at face value is not a sound practice regarding President Trump.

The childishness has to stop. Guy does one thing to offend and he’s no good.

This is serious stuff.

The judges comments don’t mean he’s all anti-Trump. He already seemed to have questioned the FBI side of it too.

Well, if the DOJ is looking to prosecute, as they have revealed that they are, then the onus is on them to prove that a crime was even committed, even before they have to try and prove that Trump committed a crime. To assert that Trump declassified the documents is to make an assertion of fact and that puts the onus on Trump’s lawyers to prove the assertion. Essentially they would be making the state’s case much easier if they did that.

There are multiple judges on the FISA court, so that might have been the presiding judge who signed off on things, but other judges may have been involved in it as well, since they rotate constantly. You can have one judge on the court today, and a different judge handling the same matter next week.

It’s not up to the accused to prove that they didn’t commit a crime. It’s up to the accuser to prove that they did.

Why didn’t his team pick retired Admiral Michael S. Rogers for special master? If I recall correctly it was Rogers that informed Trump he was being spied on and then Rogers retired.

Furthermore, the special master wants proof that the docs were declassified, simple, Trump said they were and that should be good enough since nobody else could do it. Is the special Master and the DOJ implying that our President Trump is a liar?
