It’s not the most prominent issue, but one factor in this disappointing denouement of Durham’s investigation is the problem with the jurisdiction of DC courts, and particularly DC juries. I do not know what Durham expected to leverage out of Sussman, should he have obtained a conviction, but the reason we will never know is the incredible bias of any DC jury pool.
There has to be a way to randomize venue in these instances to get a jury selection that is not Manhattan, not DC, or not city of Atlanta. These jurisdictions are so skewed that the outcome of a trial there for someone who is a Trump official or a member of the Trump family, is outside of the bounds of fundamental fairness. Likewise, in trying to convict a party aligned with Democratic Party interests, like Sussman, the prosecution has an impossible task.
