Well, that’s a problem right there. It’s an administrative finding, and is not “justiciable”. The only remedial action will be political: primary out the RINO squishes, and curb this out of control Federal administrative state.
Appeal anyway, all the way up to the Supreme Court if necessary.
This unconstitutional Administrative State needs to come to heel (and soon be destroyed).
There have been precedents set regarding due process regarding property uses in relation to enviromental laws. Yet it would take Federal court action to force due process provisions on the ATF’s actions and perhaps the famliy doesn’t have the stomach or the money to carry it out. The ATF can “define” all they wish but in the end they could be forced to prove “willfull” neglect by the courts and to set up a due process mechanism.
