Exactly backwards. The SCOTUS did not “assume the power to regulate how a state can regulate” abortion. They simply said that the states can....that the constitution was silent on abortion which it clearly was.
Exactly right!
Now states that regulate or ban abortion will be better able to fight off challenges based on a constitutional right that never existed.
How twisted was Nancy Pelosi’s rebuke today when she said that the court was hypocritical for upholding one right, the 2A, while denying another, that of abortion.
