PROSECUTING ATTORNEY: Yes we can. I would like to present this video animation as evidence.
DEFENSE LAWYER: That proves nothing. Those are just lines on a map.
PROSECUTING ATTORNEY:. (to the jury) Let me explain. What you see here is the geolocation data from a cell phone carried on the person owning the phone, displayed graphically, overlaid as a path taken on public roads on a map. This geolocation data was supplied by a commercial data warehouse that collects this tracking data anonymously from users. Overlaid on the map are red dots representing the locations of ballot drop boxes, and the red circles indicate non-profit groups being investigated for fraud who have been shown to be illegal ballot distribution areas, contrary to the laws of this state.
DEFENSE LAWYER: This is spying on American citizens without their consent!
PROSECUTING ATTORNEY: Users explicitly authorize this GPS tracking data to be used for any purpose when they install applications on their smart phone that use location services. The person with the cell phone authorized its use when they installed the application. A large dialogue box asked them to authorize it before the install took place. There is a thing called a EULA Agreement when software is acquired, and it states that installing it authorizes this data to be used. So the person carrying this phone specifically allowed it.
DEFENSE LAWYER: That data could belong to anyone, not just my client.
PROSECUTING ATTORNEY: In its bare commercial use that anyone with money can purchase, it is anonymous data. However, given that this was a felony crime being committed, we subpoenaed the manufacturer to find out who the owner of the phone is. From the data, we get the unique identifier on the phone, and we are authorized to ask the manufacturer who the phone was sold to. We have therefore tied the phone, whose path is being shown above in the video, directly to the defendant.
DEFENSE LAWYER: Cell phone GPS tracking data is notoriously inaccurate. That proves nothing except that perhaps my client drove past those ballot drop boxes.
PROSECUTING ATTORNEY: Current iterations of GPS data derived from smart phones have been shown to be accurate to within inches, not feet. The US Supreme Court has validated this assumption in recent rulings. Law Enforcement agencies as well as the US Military both utilize this data and will vouch for its accuracy.
DEFENSE LAWYER: That still is irrelevant. My client says he thought they were mailboxes, and was placing PTA letters for Thanksgiving in there. He was just driving around to find a store that sold his brand of menthol cigarettes.
PROSECUTING ATTORNEY: The path above shows that this person carrying the cell phone visited 27 different ballot drop boxes. The timing data indicates that he stayed at each location an average of 45 seconds, even though several were far longer than that. He went nowhere else, and made no other stops except traffic lights and stop signs.
DEFENSE LAWYER: That doesn't prove anything.
PROSECUTING ATTORNEY: The defendant made this circuit nearly every night, visiting these exact same drop boxes over the course of the month leading up to the election. On this particular day, this path took place at 2:30 AM in the early morning.
DEFENSE LAWYER: He could have been doing it so he didn't overload the ballot boxes he mistakenly thought were mail boxes.
PROSECUTING ATTORNEY: We tracked this phone for one month prior to the election, and one month after election. The last time the cell phone GPS data showed this travel pattern was at 21:45 PM on election night. After that, the nightly visits ceased and never recurred again.
DEFENSE LAWYER: It still doesn't prove that it was my client. He might have left it in his jacket in someone else's vehicle.
PROSECUTING ATTORNEY: His phone records which we have subpoenaed show text messages from his phone to other people, the nature of the messages indicating clearly it was the defendant sending them.
DEFENSE LAWYER: It still doesn't prove that it was my client.
PROSECUTING ATTORNEY: We made legal citizens requests for the surveillance video and obtained nearly four million minutes of footage overall. By looking at the date/time stamps on the cell phone GPS data, we were able to synch it to the surveillance video time stamp and found several instances that showed the defendant's car, a black 1998 Ford Taurus with a dent in the fender.
DEFENSE LAWYER: That doesn't mean it was the defendant driving. And that video could be doctored.
PROSECUTING ATTORNEY: From the video, you can see the defendant wearing a unique leather jacket with an emblem. We procured a search warrant for the defendant's home, and discovered a similar unique jacket that we present here as evidence. As to the authenticity of the video, that is the property of the state, which is required to keep it for 22 months after the election in a secure location. It is official state video, with a chain of custody and legally mandated secure storage for the duration required.
DEFENSE LAWYER: But my client still maintains he was mailing PTA flyers and accidentally put them in ballot boxes instead of mail boxes.
PROSECUTING ATTORNEY: Really? 27 mistaken mail boxes a night for nearly a month? We have served a subpoena for the election workers, and reviewed their process and schedule for emptying those ballot boxes, the contents of which are subject to strict custody requirements of which records are kept, and any foreign objects or regular mail must be noted and processed in a specific way. When questioned under oath, they said that, over the course of the month before election, when they checked each box once every three day, they found from all boxes a total of three pieces of regular mail, in addition to a rotten apple and a bag of dog feces. When examined, the official records they were required by law to keep, bear this out. The rotten apple was discarded, the bag of dog feces was turned over to the police, and the three pieces of mail were officially transferred to the Post Office. There were no PTA invitations.
Very well done. One small flaw is that would take 250 investigators and they only assign that amount of manpower if it a Trump supporter.
