What’s the penalty? And if there is one, who is penalized?

The first penalty could be financial. The DOJ could wind up financing PV for, oh, I dunno, a decade or so? The individuals might be able to nail down their retirement nest egg. Lotta money, at least, on the line with this mess.

Listening to denials from the perp and handwringing from Congress and the courts.

But seriously, the typical penalty on a fourth amendment violation is suppression of evidence at trial, or an order from the court that the snooper stop snooping. That order is basically "be more careful when you snoop so you don't get caught snooping."
