That would be a federal crime. I think it's actually a crime to threaten foreign leaders too... but, not clear on that... if there is a law against it, doubt it's enforced.

But as to whether it is enforced, our military without a declaration of war, shot the leader of a terrorist group in the head while he was clinging to his wives, unarmed...Ben Laden. Nothing was said.

If there was such a law, it would be enforced on a selective basis, depending on whether our current foreign policy liked the foreign leader who was threatened.
