Regardless of the mechanics of the gun, if he had checked to see if it was loaded himself, and if he had not pointed it at her, he would not have killed her.

Either way it’s a distraction. Baldwin pointed a weapon at something he allegedly didn’t intend to destroy. Yes, he should not have done that. He is a fool for doing that. However, it is important that we be as accurate as we can when describing what happened.
Baldwin might be lying, or he may be telling the truth. We don't know yet.
