In fairness, Kyle would not have known - and (arguably) his actions can only be evaluated on what he knew.
Thing is, the prosecutor brought the “hospital” up, and if he starts spinning it as implying “weak and recovering from medical problem” for sympathy, door is already open for defense to say “no, he was released from a mental hospital regarding a suicide attempt” ... which then segues to “couldn’t stay at his baby’s mother’s home because of a restraining order for beating her bloody”.
Difference is defense trying to open an otherwise closed door, vs prosecutor voluntarily opening the door and now having to try closing it.
In other words this prosecutor just made a big mistake.
