He’s definitely correct about deliberately losing lawsuits being a common ploy of the U.S. government. But there are plenty of lawsuits coming about the vaccine, and it’ll be the strongest, not the first, which makes it to the US Supreme Court.

This strategy was common in the past with abortion lawsuits. Losing cases builds a series of case law that later courts use to establish power over decisions.
