It appears that since the POTUS never takes the oath of enlistment or takes a commission as an officer they cannot be subjected to military laws. However as Commander in Chief the military could start a coup and remove him from office or state he is unfit for command and refuse any future orders.
Why hasn’t any military leader resigned rather than carry out Biden’s policy?
